Terms of service
These terms govern your use of wearantarctica.com (the "Site") and any purchase you make from it. The Site is operated by Antarctica ("we", "us", "our"). By using the Site or placing an order, you agree to these terms. If you do not agree, please do not use the Site.
1. Who can order
You must be at least 18 years old, or the age of majority where you live, and able to enter into a binding contract. By placing an order you confirm that the payment method you use is your own or that you have permission to use it.
2. Products
We sell winter outerwear and related accessories. We do everything we can to show colours, materials and measurements accurately, but screens vary and garment measurements may differ by up to 2 cm between units. Photographs are illustrative; styling items shown with a product are not included unless stated.
Our jackets are designed for everyday winter life in and around the city. They are not technical mountaineering or expedition equipment and are not intended for extreme-cold or high-risk activities.
We may change, limit or discontinue any product at any time, and we may limit the quantity available to any one customer or order.
3. Bundles, discounts and free gifts
Bundle discounts and free gifts apply automatically when the qualifying number of jackets is in your order, and only while stocks last. Free gifts have no cash value and cannot be exchanged for money. If you return items from a bundle, your refund is adjusted as described in our Refund Policy. We may change or end any promotion at any time; a change never affects an order already placed and paid for.
4. Prices and payment
All prices are in US dollars (USD). Any import duties or taxes that apply to your country are shown at checkout before you pay. Prices may change without notice, but a change never affects an order already placed and paid for.
Payment is taken at checkout. We accept the methods shown on the checkout page. Your order is an offer to buy; the contract is formed when we send your shipping confirmation.
5. Errors
Occasionally a product may be listed with an incorrect price, description or availability. We reserve the right to correct any error and to cancel an order placed against an obviously wrong price, even after the order is confirmed. If we cancel for this reason, we refund you in full immediately and tell you why.
6. Shipping, returns and warranty
Shipping times and costs are set out in our Shipping Policy. Size exchanges, returns, refunds, cancellations and our 1-year warranty against manufacturing defects are set out in our Refund Policy. Both form part of these terms.
7. Accounts
If you create an account you are responsible for keeping your password confidential and for everything that happens under your account. Tell us immediately if you suspect unauthorised use. We may suspend or close an account that is used fraudulently or in breach of these terms.
8. Acceptable use
You may not use the Site for any unlawful purpose, to infringe anyone's rights, to transmit malware, to scrape or harvest data by automated means, to interfere with the Site's security, or to resell our products as your own without written permission.
9. Intellectual property
The Site's content — text, photography, video, layout, and the Antarctica name and logo — belongs to us or our licensors and is protected by copyright and trade mark law. You may not copy, reproduce or use it commercially without our written permission.
10. Your content
If you send us reviews, photos, videos, comments or suggestions, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and publish them in connection with our business, with attribution where practical. You confirm that the content is yours to give and that it is not unlawful or defamatory. We are not obliged to publish or keep any submission, and we may remove one at any time.
11. Third-party links and services
The Site may link to third-party sites or use third-party services (payment processors, carriers, review platforms, analytics). We do not control them and are not responsible for their content, products or privacy practices. Your dealings with them are between you and them.
12. Disclaimers and limitation of liability
The Site is provided "as is". We do not warrant that it will be uninterrupted, error-free or free of harmful components.
To the fullest extent permitted by law, our total liability arising out of any order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded — and nothing here affects the statutory rights you have as a consumer.
13. Indemnity
You agree to indemnify us against any claim arising from your breach of these terms or your misuse of the Site.
14. Changes to these terms
We may update these terms at any time. The version published on this page when you place an order is the version that applies to that order. Please check back before ordering again.
15. Governing law
These terms, and any dispute arising out of them or out of any order placed on the Site, are governed by the laws of France, without regard to its conflict-of-law rules. You and we agree to the jurisdiction of the courts of Créteil, France.
This clause does not deprive you of the protection of any mandatory consumer protection rule that applies where you habitually live. If you are a consumer in the European Union or the United Kingdom, you may also bring proceedings in the courts of your own country.
